1. Terms of Service
There are a few rules about the Arvie Ambassador program you should know about. No “gotchas” here, just some terms to keep everyone happy.
Arvie’s Ambassador Program Agreement (the “Agreement”) governs your participation in the Program ("Arvie’s Ambassador Program"). This Agreement between you and MBP Outdoor Ventures LLC dba Arvie (“Arvie”) is in addition to Arvie’s Terms of Use, Privacy Policy and all other documents and provisions applicable to the use of https://arvie.com (the "Website"). By joining Arvie’s Ambassador Program you agree to be bound by the terms of this Agreement.
2. Rules of the Partners Program
If you refer a user to the Website, and the User clicks through your unique Arvie Ambassador Link to the Website, thereby identifying you as the Ambassador via your unique link, your account will be credited as a commissionable account after a referred customer converts their 7 day free trial into a paid membership.
The Ambassador’s relationship between the Ambassador and the referred User is activated the first time the User clicks on the Ambassador’s Link. If the User converts his 7-day free trial period within 30 days of the Ambassador’s referral to a User, the Ambassador will be rewarded with a commission on said conversion by this User. If the User does not convert during this 30-day period, the relationship between the Ambassador and the User will expire.
When a User clicks on an Ambassador’s link, the Website attempts to store the Ambassador’s Cookie on the User’s web browser. If the User’s browser does not accept cookies, or if the Ambassador’s Cookie is removed or has expired, the User will not be identified as Your User. For Users to be recognized as Your Users, and for commission to accrue, Users must have an unexpired Ambassador Cookie in their browser when they complete their full Arvie Profile.
Self-referrals are not allowed (i.e. signing up for Arvie through your own affiliate link)
Abuse, gaming, or attempting to mislead (i.e. posting fake discounts to coupon-sharing websites) will result in your account being permanently banned.
In some cases, we can give credit to an affiliate even if the customer didn’t sign up through an affiliate link or coupon code. If you have a case like this, please contact us and we’ll do our best to help.
No search engine ads (especially on branded terms or domain names), Facebook other social media ads or other ads that would compete with our own marketing and cause potential confusion for customers.
No Facebook or other social media ads that link to our website or anything similar that would compete with our own paid marketing and drive up our costs and potentially cause confusion.
No pretending to be acting on behalf of us (i.e. as an employee).
We reserve the right to change the Terms of Service for our affiliate program at any time.
We reserve the right to terminate your affiliate account for violation of any of the rules at our sole discretion. Commissions generated by mechanisms that are in violation of our Terms of Service will not be paid or owed.
3. Commission payment
Arvie commissions are paid:
Monthly (usually on the 1st)
Via PayPal. In order to receive payment, you must provide a valid PayPal email address.
Commission is credited to you after a referred customer converts their 7 day free trial into a paid membership
The Ambassador’s commission payment will be issued in United States Dollars (US$) through PayPal Ambassador’s account. If Arvie makes an overpayment of commissions to the Ambassador for any reason, Arvie reserves the right to deduct the amount of such overpayment from the Ambassador’s account and/or to require the immediate repayment of such overpaid Ambassador’s commissions.
4. Commission structure.
Arvie offer a tiered commission structure, and the person you refer receives a 10% discount on their membership.
Tier 1: 1 to 14 new members - 20% commission
Tier 2: 15+ new memberships - 30% commission on all previous and new memberships plus a free annual Arvie Membership.
Bonus Level 1: 50 New memberships - $500 bonus payment
Bonus Level 2: 100 New memberships - $1500 bonus payment
Arvie may modify commission percentages and/or payment schedules at any time. If Arvie modifies any percentage, only Your commission earned after the effective date of change will be affected by the change.
5. Ambassador’s Arvie membership:
All Ambassadors must sign up and register as an Arvie Member. When an Arvie Ambassador have completed his full Arvie profile, the Ambassador will receive effectively a 67-day free trial period, and the be eligible for commission payouts.
Should Tier 2 be reached in the 67 day free trail period, the Arvie Ambassador will receive a free annual Arvie membership as set out in the commission structure above.
6. Usage of Partners Links
Arvie hereby grants to the Ambassador a non-exclusive and non-transferable license to use Ambassador’s Links for placement on his or her blog, app, or internet site, for the sole and exclusive purpose of referring potential users to the Arvie Website.
Arvie reserves the right to revoke the license to use the Ambassador’s Links, in whole or part, at any time. You acknowledge and agree that all aspects of each of the Partner Links, in any language, format or medium, are and remain Arvie’s valuable and exclusive property and are protected under trade secret, copyright, trademark and/or patent law.
Arvie reserves the right to review the Ambassador’s blog, app, or internet site.
The Ambassador may not use any Ambassador Links to market, promote, or endorse the goods, services, and/or cause of any other individual or entity, or to otherwise benefit any third party, except the benefit of the User in accessing and using the Arvie Website.
7. Anti-Spamming Policy
Arvie prohibits You from engaging in any form of unsolicited commercial emailing (commonly referred to as "spamming") or the sending of emails that are misleading, spoofed, contain misleading subject lines, and/or contain inaccurate or misleading sender or recipient data. Arvie in its own discretion and not as its exclusive remedy, reserves the right to suspend, report, or terminate the Ambassador, or otherwise take remedial action if it is determined that the Ambassador was spamming or in violation of this provision. Ambassadors violating these provisions will forfeit any Arvie Ambassador Program commissions / rewards.
8. Term and Termination
This Agreement is effective as long as you participate in the Arvie Ambassador Program or until the Program is discontinued by Arvie, whichever occurs first. The Program or any aspect of it can be discontinued at any time, at Arvie’s sole discretion. Upon posting of such notice, the Program and this Agreement shall be thereby terminated.
9. Limitation of Liability
Notwithstanding anything stated or implied to the contrary, Arvie, its officers, managers, and members, shall not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, goodwill or data) arising out of or related to this Program, even if Arvie has been advised of the possibility of such damages.
10. Indemnity
You agree to indemnify, defend, and hold Arvie, and its respective directors, officers, employees, shareholders, partners and agents harmless from and against any and all claims, liability, losses, costs and expenses (including lawyers’ fees) incurred by Arvie in connection with any breach by you of this Agreement. Arvie reserves the right, at your expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with Arvie’s defense of such claim.
11. Miscellaneous Provisions
The Arvie Ambassador Program is in addition to the Website Terms of Use, any of the foregoing may be modified by Arvie from time to time, all of which together embody the parties entire agreement and supersedes and cancels any prior agreement, express or implied, written or oral, with respect to its subject matter; provided that in the event of any inconsistency between this Agreement and any such Website Terms of Use, the terms of this Agreement shall govern.
The validity, interpretation, and enforcement of this Agreement, matters arising out of or related to performance or breach of this Agreement, and related matters shall be governed by the internal laws of the State of Florida. Any legal action or proceeding concerning the validity, interpretation, and enforcement of this Agreement, matters arising out of or related to performance or breach of this Agreement, and related matters, shall be brought exclusively in the State or Federal courts. All parties consent to the exclusive jurisdiction of those courts, waiving any objection to the propriety or convenience of such venues.
12. Making Changes to the Agreement
Notwithstanding anything else in this or any other agreement, Arvie shall have the right, at its sole discretion, to make changes to the Arvie Ambassadors Program, this Agreement and/or the Website Terms of Use at any time and for any reason. No modification, deletion, amendment, or waiver of any provision is binding on Arvie unless in writing and signed by its authorized representative or posted by Arvie on the Website.
13. Acceptance of the Agreement
You acknowledge that You have read this Agreement, understand it, and have had an opportunity to seek independent legal advice prior to agreeing to it. By participating in the Arvie Ambassador Program, clicking “I Agree” or otherwise signifying acceptance, you accept and agree to be bound by this Agreement for yourself, and agree to be bound by its provisions. If you are accepting on behalf of your employer or other person or entity, you represent and warrant that you have the full legal authority to bind your employer or such other person or entity and to participate in The Program on behalf of such employer or other person or entity. Additionally, you acknowledge and agree that you have reviewed the Website Terms of Use and any other agreements which may be incorporated by reference herein and therein, and to the extent of their incorporation in this Agreement, you (and as applicable, such other person or entity) agree to be bound by them
